The way settlements are determined in a personal injury case, a lawyer gets all the documentation on lost wages, on the medical expenses, gets experts to project the future losses, then we go to the insurance company and we lay it all out.

We give them the documentation and we try to get them to pay a fair amount and typically we end up in a mediation, which means we go to a neutral party. They will listen to me, they will listen to the insurance company.

And they will try to get us to meet sometimes midway or whatever for a fair amount in order to get the case settled without having to go through an expensive court proceeding.
