Zinc in denture adhesives unlikely to damage nervous system, doctors say
In the wake of news reports that the zinc found in many denture adhesives could lead to neurological problems, hundreds of denture wearers have been calling lawyers, hoping to join the growing number of suits filed against the makers of Super Poligrip and Fixodent.
One Houston firm representing 15 plaintiffs in denture adhesive suits has received about 150 inquiries, including several dozen from the Tampa Bay area, since separate stories about the lawsuits were published in the St. Petersburg Times and the Fort Worth Star-Telegram of Texas. more...

Lazy Landlord Cost Him Leg, Tenant Claims
HOUSTON - After his landlord refused to unclog his toilet, a man says, he cut himself while clipping his toenails, the wound became infected by contact with the contaminated carpet, gangrene developed and the lower part of his leg had to be amputated.

Man Paralyzed in School Incident Receives $14.7 Million Settlement
A Chicago man injured on a mini-trampoline when he was an eighth-grade student at a South Side elementary school 18 years ago has settled a lawsuit with the Chicago Board of Education and a private youth center for almost $14.7 million, his attorneys said Thursday.
Ryan Murray, who was 13 at the time, was injured in a tumbling class on Dec. 14, 1992, at what was then Bryn Mawr Elementary School, 7455 S. Jeffery Blvd., the attorneys said. more...

What one court has called “a veritable sea change in social attitudes about homosexuality” has evidently not reached Texas where a judge ruled that an airport security guard can sue a radio show host for calling him “gay” on the air.

Plaintiff asks Judge Floyd for new trial in Bronco blow out case
In April 2009, a Jefferson County jury found no negligence on the part of Calvin Ford for indirectly selling a Ford Bronco to Eric Carlsen, who died in a wreck when the wheels came off his newly purchased sport utility vehicle.
Now almost a year later, Carlsen's family is asking Judge Donald Floyd to grant them a new trial, arguing that the jury's verdict "is against the great weight and preponderance of the evidence." more...

Motorist Who Flipped off Cop Gets $50,000 From City
The citation of a motorist for displaying his middle finger to a police officer -– what a judge described as a “somewhat innocuous” gesture -- turned out to be quite expensive for the City of Pittsburgh as it agreed to pay $50,000 to the bird-flipper.
David Hackbart flipped the bird at Sgt. Brian Elledge during an altercation over a parking space with another motorist in April 2006. After prosecutors dropped disorderly conduct charges, he sued the city in February 2007, arguing that Elledge retaliated against him for “engaging in constitutionally protected speech.” more...

Babysitter charged with injuring baby boy
An 11-month-old baby is in the hospital, said to be in grave condition. He was critically injured, allegedly by his babysitter.
Technically the suspect was watching the child, but he also lives in the same home with the toddler he's accused of critically harming. When Toyota recalled over 2 million cars last month, it was too late for one Houston family. Michael Harris is suing Toyota for an accident that caused his wife's death just a week before Christmas 2009.
Trina Harris was killed instantly when her car ran a stop sign and hit a cement wall on December 18th. She was driving a 2009 Corolla, one of the vehicles that Toyota recalled in January. Mr. Harris says his wife had mentioned that her car sometimes sped up on its own. He wants Toyota to be held accountable for its alleged negligence. more...

Five dead in Connecticut gas plant explosion
MIDDLETOWN, Conn - At least five people were killed and dozens injured on Sunday when a massive explosion rocked a gas power plant under construction in Connecticut, police said.

Station Night Club Fire Lawsuit Settled for $176 Million
A settlement of $176 million has been approved by a federal judge, ending a lengthy lawsuit stemming from the infamous nightclub fire in Rhode Island in 2003. The Station Night Club fire killed 100 people.
The settlement monies will be distributed among survivors of the fire who were severely injured, and the many children who lost their parents in the fire. A trust fund will be set up to hold funds for more than 300 people affected by the fire. more...

Judge Tosses Lawsuit Over Airline Tarmac Waits
A federal judge in Dallas dismissed a class action seeking damages for up to 33,000 American Airline passengers who were allegedly forced to wait in grounded airplanes for more than three hours, sometimes "in poor to deplorable conditions."
Lead plaintiff Thomas Dickson complained that he and his family, on their way from San Francisco to Belize on Dec. 29, 2006, were stuck on a grounded American Airlines flight for more than eight hours. more...

Texas’ highest court has nullified a $14 million verdict in favor of a couple who alleged that a defectively designed Whirlpool dryer caused a fire in their trailer that killed their teenage son.

Miami Beach Drownings Result in $5.75 Million Settlement
A $5.75 million verdict has been reached against Monticello Insurance Company, which had refused to pay a settlement between the City of Miami Beach and the families of Zachary Breaux and Eugenie Poleyeff, who drowned there in 1997.

Four crashes on Interstate 35 involving at least 15 vehicles Saturday afternoon brought northbound traffic on the highway to a crawl just north of the interchange with Farm-to-Market Road 1695 and West Moonlight Drive in Hewitt.

Mont. jury awards $850,000 in aluminum bat lawsuit
HELENA, Mont. — A jury on Wednesday found that the maker of Louisville Slugger baseball bats failed to adequately warn about the dangers the product can pose, awarding a family $850,000 for the 2003 death of their son in a baseball game.
The family of Brandon Patch argued that aluminum baseball bats are dangerous because they cause the baseball to travel at a greater speed. A 32-year-old man died on a Baytown highway early Tuesday after a witness told police they saw him driving erratically.

Accident at downtown attraction injures 27
HOUSTON - A ride at a popular downtown attraction ended with an accident and more than 27 people sent to the hospital.
Just before 11pm Saturday, a mini-train at the Downtown Aquarium rear-ended another train. It's unclear how many people were on the trains, but 31 were injured. We're told all of the injuries were minor.

Man dies at chocolate factory
An employee at a New Jersey chocolate processing plant died Wednesday after falling into a vat of hot chocolate, according to a spokesman for the Camden County Prosecutor's office.
Vincent Smith II, 29, was dumping raw chocolate into the vat for melting when he fell in from a nine-foot high platform. He suffered a fatal blow to the head from the vat's agitator, a paddle-like mechanism used for stirring the chocolate. more...

At least four medical malpractice lawsuits have been filed in recent years alleging that hospital patients died from overdoses of Diprivan –- the powerful sedative found in Michael Jackson's home after his death.
One patient, Chester Forrester, allegedly went into “respiratory and/or cardiac arrest” only four minutes after a physician at a Norfolk, Va., hospital began administering Diprivan to him as an anesthetic. New Medicare law to start July 1
A new law is slated to take effect July 1 that impacts claims involving Medicare, Medicaid and SCHIP Extension Act of 2007 (MMSEA). While Medicare has the right to reimbursement of money it paid for medical care rendered to injury victims since 1980, the MMSEA will require insurance companies to register on behalf of a Medicare claimant in an injury case. The National Transportation Safety Board cited "a medically unfit pilot, an ineffective master, and poor communications between the two" yesterday as the cause of the Nov. 7, 2007, Cosco Busan container ship's striking a tower of the San Francisco-Oakland Bay Bridge, causing a spill of more than 53,000 gallons of fuel oil into San Francisco Bay. The ship was being piloted out of the bay by the pilot in heavy fog, and he told investigators the ship's instruments were showing conflicting information. The board said the incident ultimately killed more than 2,500 birds and caused at least $73.5 million in damage, with $70 million attributed to the environmental cleanup. A man was killed in when a trench collapsed on him at a construction site near Cartersville, Georgia.
James Hilbish, 46, of Tuscaloosa, Alabama, was working when the trench, which was 30 feet deep and another 25 to 30 feet long under the roadway, collapsed during sewer line installation, said Bartow County Fire Chief Craig Millsap.
